Sexual harassment is unwelcome sexual conduct of any kind in the workplace that threatens or offends an employee. There are two types of sexual harassment:
- Quid pro quo harassment — This type of harassment occurs when someone in a position of authority with the ability to affect the employee’s job demands or requests sexual favors in return for a beneficial job action, such as a promotion, raise or positive job evaluation, or for avoiding a detrimental job action, such as firing, demotion or a bad evaluation. Theiem>quid pro quo may be a promise of a beneficial job action or a threat of a negative one, even if the promise or threat is not fulfilled.
- Hostile work environment — A hostile work environment is created when an employee encounters unwelcome physical or verbal conduct of a gender-based or sexual nature that is severe or pervasive, making it difficult for the victimized employee to do his or her job. An employer who knows of this conduct and fails to make a reasonable effort to stop and correct it can be held liable.
Sexual harassment is not limited to a male victimizing a woman or a more senior employee victimizing a less senior one. It includes any conduct of the type described above, regardless of the gender, sexual preference or role of either the perpetrator or the victim.
